These claims arise out of business dealings and traverse contract and tort law. A plaintiff must prove the elements of the particular cause of action asserted. It is up to the defense to show that the plaintiff cannot establish at least one of the elements of each cause of action asserted, to prove a legal defense, or to reduce the amount of damages.
